Terms of use and privacy

These terms cover PubSubAds (PubSubAds.com), a classifieds marketplace for buying and selling near you. By creating an account, posting an ad, browsing the site, or otherwise using PubSubAds, you agree to them. If you do not agree, do not use the service.

PubSubAds is a venue. Deals, payments for goods, meetup safety, and delivery stay between you and the other person unless we say otherwise for a paid promotion or similar feature on the platform.

1. Who may use PubSubAds

• You must be able to form a binding contract under applicable law.
• If you are under 18, you may use PubSubAds only with a parent or guardian’s consent where required.
• You must provide accurate account details and keep your password private.
• One person or business should not create accounts to evade bans, reviews, or rate limits.

2. Your account

You are responsible for activity under your account. Tell us promptly if you think someone else is using it. We may suspend or close accounts that break these terms, look unsafe, or create legal risk for PubSubAds or other users.

3. Posting and trading

• List only items and services you are allowed to sell.
• Write accurate titles, descriptions, prices, locations, and photos.
• Do not post weapons, illegal goods, stolen property, or anything that is prohibited by law or by our category rules.
• Do not spam, scrape, or automate posting or messaging in a way that harms the service or other users.
• Meet in public places when you can. PubSubAds does not verify every seller or buyer.

We may edit, refuse, hold, or remove listings, including for review of new sellers, policy checks, or safety. Paid promotions, if offered, are subject to the plan you buy and these terms.

4. Information we collect

Depending on how you use PubSubAds, we may collect:

• Account data — email, display name, password (stored as a hash), and verification status.
• Profile and place — city, region, postcode, and map coordinates you confirm so we can show nearby ads.
• Listing content — titles, descriptions, prices, categories, attributes you answer, photos, videos, and locations on ads.
• Usage and device data — pages viewed, searches, approximate location signals you choose to share, cookies or similar storage, IP address, browser type, and error logs.
• Support and safety signals — messages you send to us, reports, and records needed to investigate abuse.
• Payment data for platform fees — if you buy a promotion or similar paid feature, the payment provider processes card or UPI details. We receive status and reference data needed to apply the purchase, not your full card number when a provider handles checkout.

5. How we use that information

We use it to:

• run the marketplace: accounts, listings, search, maps, media, and notifications;
• show ads that match a place, category, or query;
• prevent fraud, spam, and abuse, and to keep the service secure;
• measure performance, fix bugs, and understand how features are used;
• communicate about your account, listings, and important service changes;
• improve PubSubAds with machine learning, as described in the next section;
• comply with law and enforce these terms.

6. AI, embeddings, and product improvement

You grant PubSubAds a worldwide, non-exclusive, royalty-free licence to host, copy, display, adapt, and otherwise use your ads, photos, answers, search behaviour, and related telemetry to operate and improve the product.

That includes the right to:

• generate vector embeddings and other machine-readable representations of listings and queries;
• build and run retrieval-augmented generation (RAG) and similar search or ranking pipelines;
• train, fine-tune, evaluate, and operate PubSubAds’ models and heuristics that power discovery, questionnaires, ranking, moderation assistance, and other user-experience features;
• create aggregated or de-identified statistics that do not identify you.

This licence continues for content that remains on the service and for copies we keep for backups, safety, legal compliance, or model improvement, even after you delete a listing, for as long as those purposes reasonably require. Deleting an ad removes it from public browse when processing finishes; it does not always erase every derived embedding or safety log immediately.

7. Data sharing and sale

We do not sell your personal data to external parties. We do not rent or trade mailing lists of PubSubAds users.

We may share data only in these limited cases:

• Service providers who process data for us under contract — for example cloud hosting, databases, caches, object storage for photos, email delivery, maps or place lookup, payment processing for platform fees, and logging or monitoring. They may use the data only to provide those services to PubSubAds.
• Other users, when you publish an ad: title, description, price, place, photos, and similar public listing fields are visible to people who browse PubSubAds.
• Legal and safety — if required by law, court order, or to protect people from serious harm, fraud, or abuse.
• Business transfers — if PubSubAds is involved in a merger, acquisition, or asset sale, user data may transfer under continuing privacy commitments.

Public listing content may appear in search results, shares, and caches outside PubSubAds once you publish it. Choose carefully what you put in an ad.

8. Cookies and similar technology

We use cookies and local storage for sign-in, your selected place, preferences, and basic analytics that help the site work. You can clear cookies in your browser; some features will stop working until you sign in or set a place again.

9. Retention

We keep account and listing data while your account is open and for a reasonable period afterward for backups, disputes, fraud prevention, and legal duties. You may ask us to close your account. We may retain limited records where the law or safety requires it.

10. Your rights

Subject to applicable law (including India’s Digital Personal Data Protection Act where it applies), you may request access to, correction of, or deletion of personal data we hold about you, or withdraw consent where processing is based on consent. Contact us using the details below. Some requests may be limited when we must keep data for security, legal, or operational reasons.

11. Intellectual property

PubSubAds’ name, design, software, and trademarks belong to PubSubAds or its licensors. You may not copy or reverse engineer the service except as allowed by law.

You keep ownership of content you post. You represent that you have the rights needed to post it and to grant the licence in section 6. Do not upload photos or text that infringe someone else’s copyright or other rights.

If you believe content on PubSubAds infringes your copyright, send a notice with your contact details, a description of the work, the location of the material on PubSubAds, and a statement that you have a good faith belief the use is unauthorised. We may remove or disable access to the material and, where appropriate, notify the poster.

12. Third-party services

Maps, storage, payments, and similar features may rely on third parties. Their terms and privacy notices apply to their processing. PubSubAds is not responsible for third-party sites or apps you open from a listing or link.

13. Disclaimers

PubSubAds is provided “as is” and “as available.” We do not guarantee uninterrupted access, perfect search results, or that every listing is genuine, safe, or accurately described. You use the service at your own risk.

14. Limitation of liability

To the fullest extent allowed by law, PubSubAds and its operators are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the service or from deals with other users. Our aggregate liability for claims relating to the service is limited to the greater of (a) the fees you paid PubSubAds for platform features in the three months before the claim, or (b) INR 2,000. Nothing in these terms limits liability that cannot be limited under applicable law.

15. Indemnity

You will defend and indemnify PubSubAds against claims arising from your content, your use of the service, or your breach of these terms, to the extent permitted by law.

16. Changes

We may update these terms. The “Last updated” date will change when we do. Continued use after the update means you accept the revised terms. If a change is material, we will try to give reasonable notice through the product or by email when we have an address.

17. Governing law

These terms are governed by the laws of India, without regard to conflict-of-law rules. Courts in India have exclusive jurisdiction, subject to any mandatory consumer protections that apply where you live.
